The Terms and conditions of Use (hereinafter referred to as "Terms of Usage") describe and govern the User's use of the content and services offered by the Alpha Astro mobile app (hereinafter referred as "We" "Alpha Astro" "us" "our" " app" ).
UPDATION
The Website may update/amend/modify these Terms of Usage from time to time. The User is responsible to check the Terms of Usage periodically to remain in compliance with these terms.
USER CONSENT
By accessing the App and using it, you ("Customer", "Client" "You", "Your", "User") understand the terms unconditionally & give consent to the Terms of Usage of this APP. If you do not agree with the Terms of Usage, please do not use the app. Before using or registering on the APP the user must read the Terms of Usage carefully. Your use of App will be taken as an agreement of use of Terms and Conditions (irrespective of the amendments made from time to time).
REGISTRATION AND ELIGIBILITY
The User of the APP must be of the age 18 or above who can form legally binding contracts under Indian Contract Act, 1872. A minor under the age of eighteen (18) is not permitted to use this App. The APP is not be held responsible for any misuse that may occur if any person includes a minor using the services provided by the App.
For a User to use the App, the User has to Register on the APP whereby You (User) agree to provide updated, current and accurate information while registering as a user. All information that you provide to the app and all updates made later will be referred to in these Terms of Usage as "Registration Data."
An account can be created through Phone number(username) and OTP (password). The user hereby assures that all information provided is updated accurately and completely. Use of account of any other USER is strictly prohibited. In the condition of inaccurate data provided by the USER, the APP holds the right to terminate the user account and restrict the user from creating and further account.
The Right Of Usage is entitled to the actual owner of the account and cannot be transferred to any other user. The original owner of an account is responsible for the protection of secrecy to the username and password. The User will be responsible for all the activities done through their account. The App in no case will be responsible for any damages caused to the privacy or finances of the USER Account if the USER fails to protect the confidentiality of their account. The USER is advised to notify the App in case of unauthorized use of their Account. For security reasons At the end of the session, the User must log out of their account at the end of the session.
The user will be informed earlier about the services which include third-party interaction. The App has no control over the information shared with any third party.
The user is in agreement with the fact that any data which includes personal information or financial information used on the internet can be stolen/ hacked or misused, Payment Gateway, and third parties in such cases the APP has no control over the matter.
The APP does not permit the use of any Services by any User under the following conditions: -
The Jurisdiction which applies to the user does not allow the use of services provided by the Alpha Astro App.
If the User's State/Country law, regulation, treaty, or administrative act stops its citizens
Due to any religious practices.
The user has created multiple accounts using various mobile numbers. The User may not have more than one active account with the Website.
FEATURE "CALL WITH ASTROLOGER"
The App provides a service that includes a feature that uses your contact number for communication with astrologers. By agreeing to these terms and conditions USER is giving consent to the APP for allowing calls from astrologers on the provided number even if DND is active.
APP CONTENT
Using this App the USER or ASTROLOGER shall not post any content that violates the rights of others, unlawful material, abusive, defamatory, invades privacy, vulgar, obscene, profane or otherwise objectionable, promotes criminal offense, hurts religious sentiments, give rise to civil liability, violate any law, incite violence or promote terrorism. These may lead to account termination.
Users should not consider any guidance provided by any third-party service as medical advice in such cases the APP carries no responsibility.
The APP holds all the rights and authority to terminate suspend any USER and ASTROLOGER account if found in violation of the terms of usage.
After following the solutions suggested by astrologers the App does not have any responsibility and does not provide any guarantee for these suggestions to work. In case something goes wrong while implementing any such advice the user is fully responsible for the risk involved.
By agreeing to these terms USER is accepting that in case of any dispute raised due to the consultation or suggested remedies by ASTROLOGER will be purely a matter between USER and ASTROLOGER the APP in no way will be a party to the dispute. All the required information will be provided to the law authority if needed regarding the dispute.
USER ACCOUNT ACCESS
The app has access to all the information created by USER.
It is to maintain the services and to offer assistance in case of resolving any issues regarding app functioning and provides the best possible services. Please also read the Privacy Policy page of the site for more details.
PRIVACY POLICY
Users know hereby agrees that the user has thoroughly read all the Terms and Conditions and Privacy Policy and agrees to all its points.
BREACH AND TERMINATION
The App holds the right to alter, discontinue or terminate services or any account with or without any prior notices.
User if Violate any condition of the Terms of Usage the account of the user will face immediate cancellation of account. The App holds all the right to initiate any action immediately :
If the data provided by the user is not authentic.
If the actions of the user cause any legal liability to the app or other users.
If the user has provided false and misleading data which causes problems in the use of the app or has violated other policies.
In the case of Astrologers, if they share personal details with customers strict action that will lead to termination of account will be taken
DELIVERY, CANCELLATION, AND REFUND
No refund will be initiated in case once the request to call is made or call is intitated. It is the User's risk if orders are made without properly going through services.
No refund will be initiated if there is a delay in services as per the timings mentioned in the app. All the services and reports updated will sometimes take time which do not lead to any kind of refunds.
No refund will be done if the data provided by you is incorrect please recheck all information before submitting no transactions will be refunded in such case
No refund will be processed if a user provides wrong contact number for contacting any astrologer.
No refunds will be made if you are not satisfied with the consultation of the astrologer this is purely a case of chance and the user will bear this risk.
For Astrologers, if the user does not pick up the call the company is in no way liable to pay the Astrologer as the revenue is generated only when the call is connected.
In case of withdrawal for an Astrologer, it may take some time if there is some problem while withdrawal the transaction. No immediate or individual funds will be transferred from the company or any executive it will only be done through the APP.
In case of account termination, no amount will be refunded to the USER or Astrologer i.e the recharge amount or Astrologer earning.
The Users cannot use the recharge amount as a currency as it is just a Talktime value.
The refunds, if any, shall be processed after deduction of the transaction charges levied by the Bank and/or the Payment Gateway, to & fro cost of the shipping and/or courier charges (With regard to purchase of a product listed on the Website), customs duty (if levied) and/or any other charges that may have been incurred by the Website during processing and/or delivering the service, as applicable.
All transactions are helped through secure payment gateways and issues in the transaction will be settled by their side which may take some time.
In case of multiple payments for a particular service, the extra amount will be refunded.
USER OBLIGATION
The User (inclusive of the astrologer and the Member Customer) under an obligation not to violate the privacy policy, terms and conditions and any other terms as defined on the App. The User represents that he is an individual and not a corporation or other legal business entity. The rights to use the APP's services is personal to the User.The User shall while using the APP and engaged in any form of communication on any of the forums inclusive of the products listed on the APP shall not violate the terms and conditions which are inclusive of:-
The User shall not Post, publish or transmit any messages that is false, misleading, defamatory, harmful, threatening, abusive, harassing, defamatory, invades another's privacy, offensive, promotes racism, hatred or harm against any individual or group or religion or caste, infringes another's rights including any intellectual property rights or copyright or trademark, violates or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability.
The User shall not upload or post or otherwise make available any content that User do not have a right to make available, under any law or under contractual or fiduciary relationships.
The User shall not upload or post or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party. The User may, however, post excerpts of copyrighted material so long as they adhere to Fair Use guidelines.
The User shall not collect screen names and email addresses of members who are registered on the APP for purposes of advertisement, solicitation or spam.
The User shall not send unsolicited email, junk mail, spam, or chain letters, or promotions or advertisements for products or services.
The User shall not upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer.
The User shall not engage in any activity that interferes with or disrupts access to the APP
The User shall not attempt to gain unauthorized access to any portion or feature of the APP, any other systems or networks connected to the APP, to any of the services offered on or through the APP, by hacking, password mining or any other illegitimate means.
The User shall not violate any applicable laws or regulations for the time being in force within or outside India. The use and continuous use of the APP is subject to but not limited to using the services for personal use.
The User shall not resell or make any commercial use of the Services without the express written consent from the APP.
The User shall not violate these Terms of Usage including but not limited to any applicable Additional terms of the APP contained herein or elsewhere.
The User shall not Reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the APP.
The User by becoming a Registered Member of the APP agrees to the following situations, which list is not exhaustive and may include services incidental to the below mentioned: -
The User agrees to receive certain specific emails and SMS alongwith calls from the APP.
The User agrees not to transmit via the APP any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature.
The User not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited.
The User shall not interfere with any other members' use or enjoyment of the APP or Services.
The User is under an obligation to report any misuse or abuse of the APP. If you notice any abuse or misuse of the APP or anything which is in violation of this Agreement, you shall forthwith report such violation to APP by writing to Customer Care. On receipt of such complaint, APP may investigate such complaint and if necessary, may terminate the membership of the Member responsible for such violation abuse or misuse without any refund of the subscription fee.
Any false complaint made by a Member shall make such Member liable for termination of his / her membership without any refund of the subscription fee.
The APP reserves the right to withdraw its services to any customer who is found to be unreasonable or abusive during their conversation with the Service Provider inclusive of astrologer regardless of any reason.
NOTICES
Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made either via email or snail mail. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in the snail mail, to Member at the address provided by Member in the Registration Data and to the Website at the address set forth below:

All legal matters will be handled in Telangana High Court, Hyderabad.
